These terms and conditions of use (“Terms of Use”) govern your use of our online interfaces and properties (e.g., websites and any mobile applications) owned and controlled by The Saville Spine Institute, P.A. and any respective affiliates (collectively “The Saville Spine Institute,” “We,” “Us,” or “Our”), including the www.savillespine.com website (the “Site”) and the services available to users through the Site (collectively the “Services”).
Your compliance with these Terms of Use is a condition to your use of the Site. If you do not agree to be bound by the Terms of Use, you are not authorized to access or otherwise use the Site, services or any information provided through the Site or Services so promptly exit this Site.
Please also consult the Site for a description of our privacy practices and policies (the “Privacy Policy”, including how we collect and handle your personal health information and financial information. The Privacy Policy is hereby incorporated into these Terms of Use by reference and constitutes a part of these Terms of Use. No Doctor-Patient Relationship Created By Virtue of Visiting the Site:
No individual is considered a patient of The Saville Spine Institute nor is any doctor-patient relationship created merely by virtue of visiting the Site; an individual does not become a patient of The Saville Spine Institute, nor is any doctor-patient relationship created unless and until such individual and The Saville Spine Institute agree to the same in writing.
Use of and/or accessing of the Site is not intended to provide diagnosis, treatment or medical advice and should NOT be used, relied upon, or replace any medical advice or prescription medical device recommended by your doctor.
Eligibility:
In order to qualify to use the Services, the following must be true:

- You agree to be legally bound by and comply with these Terms of Use.
- You understand and agree that satisfying the above requirements does not guarantee that you will become a patient of The Saville Spine Institute.
In addition to the above requirements, we reserve the right to change or include new requirements as deemed appropriate in our sole discretion without providing prior notice to you.
If you are below the age of majority in your place of residence, you may only download, install, access or use the Services under the supervision of a parent or legal guardian who agrees to be bound by these Terms of Use and our Privacy Policy. If you are a parent or legal guardian of a minor child, you may, in compliance with these Terms of Use and our Privacy Policy, access or use the Services on behalf of such minor child. Any information that provided to The Saville Spine Institute while using The Saville Spine Institute Services on behalf of such minor child will be treated as provided in these Terms of Use and the Privacy Policy.
You will not use the Services or any Content in a manner prohibited by any applicable state, federal, international or local laws, rules, restrictions or regulations.
Requirements for Use:
You must have compatible computing and/or mobile devices, access to the Internet, and certain necessary software in order to use the Site. Fees and charges may apply to your use of the mobile services and to the Internet.
Your Information and Security:
To access or use the Services, you may be required to provide certain registration details or other information (“Your Information”). If you provide Your Information to us, then you agree to provide true, current, complete and accurate information, and not to misrepresent your identity. You also agree to keep Your Information current and update Your Information if any of Your Information changes. Relationship with The Saville Spine Institute:
The Saville Spine Institute does not provide or render medical services via the Site; use of the Site is not intended to be, and must not be taken to be, the practice of medicine, dentistry, nursing or any other professional healthcare advice or opinion. NONE OF THE CONTENT YOU RECEIVE THOUGH THE SITE SHOULD BE CONISDERED MEDICAL ADVICE.
By accepting the Terms of Use, you agree and consent to The Saville Spine Institute and its affiliates sending you disclosures, notices, messages, reports, and other communications. It is your responsibility to monitor these communications. You acknowledge and agree that you will not hold us or any affiliate liable for any loss, injury, or claim of any kind resulting from your failure to read these communications or for your failure to comply with any recommendations contained in these communications.

Termination:

Subject to applicable law, The Saville Spine Institute reserves the right to maintain, delete or destroy all communications and materials posted or uploaded to the Sites pursuant to its internal record retention and/or content destruction policies. After such termination, The Saville Spine Institute will have no further obligation to provide the Services, except to the extent an affiliated professional entity is obligated to provide you access to your health records or is required to provide you with continuing care under applicable legal, ethical and professional obligations to you. You agree that if your use of the Services is terminated pursuant to these Terms of Use, you will not attempt to use the Services in any way, and further agree that if you violate this restriction after such termination, you will indemnify and hold The Saville Spine Institute harmless from any and all liability that The Saville Spine Institute may incur therefore.
Disclaimer of Warranties:
YOU EXPRESSLY AGREE THAT USE OF THE SITE IS AT YOUR SOLE RISK. YOU ACKNOWLEDGE AND AGREE THAT THE SITE AND ANY SERVICES ARE PROVIDED THROUGH THE SITES ON AN “AS IS” AND “AS AVAILABLE” BASIS. To the extent that we may not, as a matter of applicable law, disclaim any implied warranty or limit liabilities, the scope and duration of such warranty and the extent of our liability will be the minimum permitted under such applicable law.
Indemnification:
You agree to defend, indemnify and hold The Saville Spine Institute harmless from and against all third party claims, damages and expenses (including reasonable attorneys’ fees) against or incurred by The Saville Spine Institute arising out of your breach of these Terms of Use or violation of applicable law, or access by anyone accessing the Site using your user ID and password.
Claims of Copyright Infringement:
We disclaim any responsibility or liability for copyrighted materials posted on our site. If you believe that your work has been copied in a manner that constitutes copyright infringement, please follow the procedures set forth below.
The Saville Spine Institute respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (“DMCA”), we will respond promptly to notices of alleged infringement that are reported to The Saville Spine Institute at: info@savillespine.com.
Notices of Alleged Infringement for Content Made Available on the Site:

Governing Law; Dispute Resolution; Arbitration; Venue; Severability of Provisions:
PLEASE READ THIS SECTION CAREFULLY BECAUSE IT REQUIRES YOU AND THE SAVILLE SPINE INSTITUTE TO RESOLVE ALL DISPUTES BETWEEN US THROUGH BINDING INDIVIDUAL ARBITRATION AND LIMITS THE MANNER IN WHICH YOU CAN SEEK RELIEF FROM THE SAVILLE SPINE INSTITUE.
These Terms of Use and your use of the Sites shall be governed by the laws of the State of Florida, without giving effect to the principles of conflict of laws. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. Any dispute arising under or relating in any way to these Terms of Use will be resolved exclusively by final and binding arbitration in Palm Beach County, Florida under the rules of the American Health Lawyers Association, except that either party may bring a claim related to intellectual property rights, or seek temporary and preliminary specific performance and injunctive relief, in any court of competent jurisdiction. The parties agree that the courts located in Palm Beach County, Florida shall have exclusive personal jurisdiction, subject matter jurisdiction, and venue for any such claim.
All parts of these Terms of Use apply to the maximum extent permitted by law. The Saville Spine Institute and you both agree that if we cannot enforce a part of this contract as written, then that part will be replaced with terms that most closely match the intent of the part we cannot enforce, to the extent permitted by law. The invalidity of part of these Terms of Use will not affect the validity and enforceability of the remaining provisions. The section headings are for convenience only and do not have any force or effect.
Prohibition of Class and Representative Actions and Non-Individualized Relief:
YOU AND WE AGREE THAT EACH OF US MAY BRING CLAIMS AGAINST THE OTHER ONLY ON AN INDIVIDUAL BASIS AND NOT AS PART OF ANY PURPORTED CLASS OR REPRESENTATIVE ACTION OR PROCEEDING. UNLESS BOTH YOU AND WE AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN MORE THAN ONE PERSON’S OR PARTY’S CLAIMS, AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A CONSOLIDATED, REPRESENTATIVE OR CLASS PROCEEDING. ALSO, THE ARBITRATOR MAY AWARD RELIEF (INCLUDING MONETARY, INJUNCTIVE AND DECLARATORY RELIEF) ONLY IN FAVOR OF THE INDIVIDUAL PARTY SEEKING RELIEF AND ONLY TO THE EXTENT NECESSARY TO PROVIDE RELIEF NECESSITATED BY THAT PARTY’S INDIVIDUAL CLAIM(S). ANY RELIEF AWARDED CANNOT AFFECT OTHER USERS.
THEREFORE, YOU DO NOT HAVE THE OPPORTUNITY TO GO TO COURT TO ASSERT OR DEFEND YOUR RIGHTS AND YOU GIVE UP YOUR RIGHT TO PARTICIPATE IN OR BRING CLASS ACTIONS. BY USING THE SAVILLE SPINE INSTITUTE’S SERVICES, YOU CONSENT TO THESE RESTRICTIONS.
Force Majeure.
We will not be deemed to be in breach of these terms or liable for any breach of these terms or our privacy policy due to any event or occurrence beyond our reasonable control, including without limitation, acts of God, terrorism, war, invasion, failures of any public networks, electrical shortages, earthquakes or floods, civil disorder, strikes, fire or other disaster.
No Agency Relationship:
Neither these Terms of Use, nor any Content, materials or features of the Services create any partnership, joint venture, employment, or other agency relationship between us and you. You may not enter into any contract on our behalf or bind us in any way.
Remedies:
You agree that any violation, or threatened violation, by you of these Terms of Use constitutes an unlawful and unfair business practice that will cause us irreparable and unquantifiable harm.
